Reporting infringement
Your notice must include all of the following, or we may not be able to act on it:
- Your physical or electronic signature (typing your full name works).
- The copyrighted work you believe is being infringed.
- The KodaCade page or game that infringes it, with its web address.
- Your name, mailing address, phone number and email address.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for them.
When we receive a complete notice we remove or disable the material, and we tell the developer or user who posted it. Sending a notice that knowingly misrepresents infringement can make you liable for damages.
Responding to a takedown (counter-notice)
If your game or content was removed and you believe it was a mistake or misidentification, you can send a counter-notice that includes:
- Your physical or electronic signature.
- What was removed and where it appeared before removal.
- A statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, if you are outside the United States, any judicial district where KodaCade may be found), and that you will accept service of process from the person who sent the notice.
We forward counter-notices to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they have gone to court, we may restore the material.
Repeat infringers
We close the accounts of developers and users who repeatedly infringe others' copyrights.
